The tie moved the contest to the House of Representatives who would vote to decide the next executive. The parties again plunged into infighting and deceit trying to maneuver and lobby their way to a favorable position. Thomas Jefferson tried to convince Burr to accept the Vice Presidency but he refused.,[link widoczny dla zalogowanych]
There was public support for Jefferson, but in the House there was division. If they could not decide by March 4 the country would be without a President until Congress reconvened in December. During that time Congress with the Federal Party in the majority would be in control.
A Tied Election
Votes were taken and the tie held. Every Representative was spoken to, but the one who garnered the most interest was James Bayard of Delaware. Bayard was the sole representative of the state and with him rested the one vote that could decide the election. He had indicated he would support Burr.

The Republicans were concerned that, if elected, the Federalists would continue to increase federal powers. They would diminish the states’ autonomy and the form that would emerge would be like the English system they had fought to change. The Federalists had been at the helm for three terms and under them had sought to give shape to the new federal government. They were concerned that if they lost the system they had worked so hard to establish would be dismantled.
As the House tried to resolve the issue the American people became caught up in the affair. The population of Washington D.C. surged to some one hundred thousand as people came to be close to the center of the action. Some spoke of the potential for war,[link widoczny dla zalogowanych], arms were seized in Philadelphia. It was a time of great uncertainty; however, these threats helped push forward the resolution.
Peaceful Resolution
Bayard sought out a Republican close to Jefferson. Delaware would abstain from the voting if terms that the Federalists had sought earlier were fulfilled (to keep prominent Federalists in office and continue certain policies). He was given an assurance by someone in Jefferson’s circle and the next day Bayard kept his word abstaining when the Federalists met to vote. Instead of moving ahead they decided they would suspend the meeting and seek out the intent of the two candidates.

The Election of 1800 pit two rival factions against one another for the highest office in the country. The nation was still in its infancy and the Federalists and Republicans were the two emerging parties that would dominate politics. The candidates were John Adams and Charles Pickney for the Federalists and Thomas Jefferson and Aaron Burr for the Republicans.
As the election drew near the fight got nasty. Name calling, unsavory letters about one another were printed,[link widoczny dla zalogowanych], and scandalous accusations were made. At the time the candidate with the most votes won the office of the presidency while the runner up filled the Vice-Presidency. When the votes were finally cast Jefferson and Burr tied for 73 Electoral votes,[link widoczny dla zalogowanych], Adams received 65 and Pickney 64.
Burr was not to be found and he no longer seemed to be someone they could work with, the party turned to Jefferson. On February 17 the House gathered to cast the 36th vote in which Bayard again abstained, Jefferson was to be the third President of the United States. Publically Bayard offered many reasons for his change of heart including protecting the country from war and the sway of the public; whatever the rational the contest was concluded.
